View Full Version : A Small Legal Question

... Greetings, B5 / JMS fans.

... I've a legal question I'd like to throw out.

... For the last 6 months I have been building a computer program (while not doing my real job). I'm learning a new language, and the best way to learn a new language is build something interesting, rather than just try to memorize syntax from a bunch of books. So I have been writing a Babylon 5 game.

... In the game I use graphics from the television program, including characters, space shots, etc... All the intellectual property of JMS, his Babylon 5 team, Warner Brothers, etc...

... I've done this kind of thing before years ago (a Malteese Falcon game), and I sent copies to friends... who sent copies to their friends... until I was getting e-mails from people I've never heard of asking me about program bugs and the like . . .

... To my question: I freely give this work to people, who freely give it to other people.... No money is being made by anybody here... But people are being entertained by both my work AND by the work of JMS and his team (all my graphics, backgrounds, background game plot, etc...)

... I really don't want to stop (and I won't), but before I pass this software on to people, I want to know if this is legal. I hardly want to become an outlaw! Should it be unlawful, I guess I can keep it to myself.

... Should anybody have any helpful input I would be very grateful. Thanks!

I'm no lawyer but JMS has been asked similar questions in the past.

I understand that in the past WB has been good about overlooking websites using their material as long as proper copyright information was attached. Games, seem to be a different matter, however, as noted in this post (http://www.jmsnews.com/msg.aspx?id=1-3262&query=web%20site%20copyright) by JMS.

Here's another post (http://www.jmsnews.com/msg.aspx?id=1-2145&query=web%20site%20copyright) that explains some things about copyright and why WB is likely to protect its catalogue.

You can always head to firstones.com (http://www.firstones.com/) and ask there, there are a bunch of B5 game and mod developers that probably came across those legal questions.

Or you can contact WB themselves.

... Jan, you're the man. Ranger 1, thanks!

... It all seems so inncocent, just doing it for kicks, to help myself learn something... But best it seems to keep it to myself.

... Thanks again, guys. That was easier than I expected.
